IPRC, in cooperation with the Ministry of Justice of Armenia, held a Round Table Discussion on RA Civil Code, Chapter 10 (Intellectual Property). Participants discussed the importance and efficiency of more than ninety intellectual property (IP) provisions of the Armenian Civil Code. The roundtable was attended by the Deputy Minister of Justice Mr. Aram Orbelyan, the Advisor to the Minister of Justice and the Chair of the Law Department of the French University in Armenia Mrs. Nora Sargsyan, as well as representatives from the Ministry of Economy of Armenia; the Armenian Intellectual Property Agency (Patent and Trademark Office), local law firms and various private companies and organizations.

Participants noted that the majority of the Chapter 10 provisions of the Civil Code are reiterated in various laws regulating different fields of IP, in Armenia (e.g. "Trademark Law," "Law on Copyright and Related Rights," "Law on inventions, utility models and industrial designs," etc.). Based on their experience and the international best practices, participants noted that reiteration of the same or similar provisions in laws with different degrees of power may not only be inefficient but also cause various problems in the phase of enforcement.

Due to many repetitions of similar provisions, amendments of IP provisions made in separate laws, usually, automatically, require amendments in the Civil Code, and vice versa. As a result, it usually creates unjustified double work and, many times, unforeseen contradictions between provisions of the Civil Code and various IP laws which are usually revealed in the phase of enforcement.

Based on the foregoing and considering various other issues participants proposed to significantly reduce the number of IP provisions of the current Civil Code. Many participants expressed their interest in and willingness to assist with developing a draft law proposing amendments in the Chapter 10 of the Civil Code.

Venue: American University of Armenia, 40 Baghramyan Ave.

On February 8-9, 2014, IPRC held its 4th annual IP Moot Court Competition in Armenia. Teams from five different law schools once again took part in the two-day event at the American University of Armenia and once again  impressed the judges with their skills and knowledge in the field of Intellectual Property rights.

Over the past four years, the IP Moot Court has become one of the biggest and most popular IP events in Armenia. Once a year, it draws together a wide range of people in this field from both private and public sectors. Students from private and public law schools attend to compete with each other and show their skills and knowledge. IP lawyers from private law firms, representatives from state authorities and authors' rights societies attend to serve as judges for the IP Moot Court. The organizer of the Moot Court does its best to assure that the competition is an educational and public awareness raising event, giving opportunity to law students to enhance their writing and oral argumentation skills in the field of Intellectual Property rights, while wrestling with cutting edge issues in IP law.

The experience of past four years also shows that the IP Moot Court is gradually becoming an ideal place for law firms, state authorities and other interested organizations to recruit talent in IPR among both participant students and graduates who are invited to serve as judges for the IP Moot Court. This year, for example, one of winning team students from the French University in Armenia was proposed an employment by Knyazyan & Partners IP Law Firm, at the conclusion of the competition. Last year, one of the winning team students from the European Regional Educational Academy was recruited by another local law firm.

Considering the important role that the IP Moot Court plays in this field in Armenia, IPRC will continue developing and strengthening its relations and cooperation with all interested universities, law schools, state authorities and the private sector.

IPRC extends its sincere gratitude and appreciation to all universities, judges, volunteers and all other participants of the IP Moot Court.  We would also like to extend our special thanks to the American University of Armenia for its continued support, once again graciously hosting the IP Moot Court on its premises.

We are confident that the efficient cooperation of all stakeholders will foster more rapid development of the IP field in Armenia, which plays a crucial role in a knowledge-based economy.
